Welcome to The Gift Company. The Gift Company is operated by Ecommerce Advisory Group Pty Ltd, ABN 16 689 668 371. In these Terms & Conditions, the terms “we”, “us” and “our” refer to The Gift Company and Ecommerce Advisory Group Pty Ltd.
These Terms & Conditions apply to your use of our website, online store, products, services, information, content, features and tools. By visiting our website, placing an order, creating an account or using our services, you agree to be bound by these Terms & Conditions, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.

1. Online store and Shopify
Our online store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products and services to you. Any purchase you make through our store is made directly with The Gift Company, operated by Ecommerce Advisory Group Pty Ltd.
Shopify is not responsible for any aspect of the sale between you and us, including the quality, delivery, return, refund or use of any products purchased from our store.
2. Eligibility and account use
By using our website or placing an order, you confirm that you are at least the age of majority in your state, territory or country of residence, or that you have permission from a parent or guardian to use our website.

Product descriptions, prices, offers and availability may change at any time without notice. We reserve the right to discontinue any product, limit quantities or correct errors where necessary.
Some products may include fragrance, skincare, bath, body, home fragrance, beauty, wellness or personal care items. Please read all product information, ingredients, warnings and usage instructions before use. 4. Orders
When you place an order through our website, you are making an offer to purchase the selected products. An order is not accepted until payment has been processed and we have confirmed your order.
We reserve the right to accept, decline, cancel or limit an order where necessary, including where:
- An item is unavailable or out of stock.
- There is an error in product information, pricing, shipping or availability.
- We suspect fraud, misuse, unauthorised activity or breach of these Terms.
- Payment is declined or cannot be verified.
- Delivery to the nominated address is not available.
If we cancel or make changes to an order, we will attempt to notify you using the email address, billing address or phone number provided at checkout.
5. Prices, payments and promotions
All prices are listed in Australian dollars unless otherwise stated. Prices may change without notice. The price charged for an item will be the price shown at the time your order is placed, subject to any correction of errors.
Promotions, discount codes, free gifts, bundles, sale offers and other offers may be subject to additional terms, exclusions, minimum spend requirements, expiry dates and stock availability. We reserve the right to modify, suspend or cancel promotions at any time.
Only one discount or promotion may apply per order unless expressly stated. Discount codes cannot usually be applied after an order has been placed.
You agree to provide current, complete and accurate payment and billing information. By submitting payment details, you confirm that you are authorised to use the selected payment method.
6. Shipping and delivery
Shipping times shown on our website are estimates only and are not guaranteed. Delivery times may be affected by carrier delays, public holidays, peak periods, weather events, incorrect addresses, customs processing, supplier delays or other events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed deliveries or additional charges caused by incorrect or incomplete address details provided at checkout.
Once an order has been dispatched, delivery is handled by the relevant shipping carrier. We will assist with reasonable delivery enquiries, but some delivery issues are outside our direct control.

7. Returns, refunds and exchanges
Returns, refunds and exchanges are handled in accordance with our Returns & Refunds Policy.
Change-of-mind returns may be accepted only where they meet our return eligibility requirements, including timeframes, condition of goods and approval before return. Certain items, including hygiene, personal care, beauty, bath and body items, clearance items, final sale items, custom items and other excluded products, may not be returnable for change of mind unless required by law.
Nothing in these Terms & Conditions or our Returns & Refunds Policy limits your rights under the Australian Consumer Law. You may be entitled to a repair, replacement, refund or other remedy if a product fails to meet a consumer guarantee.
8. Damaged, faulty, incorrect or missing items
Please inspect your order as soon as it is delivered. If an item is damaged, faulty, incorrect or missing, please contact us promptly with your order number, clear photos and any other requested information so we can review the issue.
For damaged parcels, we may require photos of the outer packaging, inner packaging and affected item, and may request a short video showing the parcel and contents. This helps us assess the issue and support any carrier claim.
Where an issue is verified, we will provide a suitable remedy in accordance with our policies and applicable law.
9. Clearance and final sale items
Clearance, final sale, discontinued, near-expiry, unboxed or imperfect-packaging items may be sold as is. These items may have cosmetic packaging imperfections, dented boxes, faded packaging, missing outer boxes or other clearly stated conditions.
Clearance and final sale items are not returnable for change of mind unless required by law. This does not affect your rights under the Australian Consumer Law if an item has a fault, defect or other issue that gives you a legal right to a remedy.
10. Gift cards, store credit and promotional credit
Gift cards, store credits and promotional credits are subject to the terms stated at the time of issue. They may not be redeemable for cash unless required by law.
Store credit and promotional credit may be subject to expiry dates, exclusions or other conditions where permitted by law.
11. Intellectual property
All content on our website, including text, images, graphics, logos, product content, page layouts, icons, video, audio, design elements and other materials, is owned by or licensed to The Gift Company, Ecommerce Advisory Group Pty Ltd, our suppliers, partners or licensors.
You may access and use our website for personal, non-commercial purposes only. You must not copy, reproduce, distribute, modify, publish, display, scrape, download, store, transmit or exploit any part of our website or content without our prior written consent.
